Today’s Challenges

IT Buyers have expressed concern over the amount of time and energy required to traverse the buying cycle necessary to procure the optimal solution for their needs. These buyers have stated that the discovery and research phases are long, arduous, and often incomplete. Further, they have spotlighted a need for stakeholder collaboration tools as a key to overall success.

IT Vendors, on the other hand, can find difficulty competing for brand awareness and IT buyer mindshare. According to research data, a typical buyer is anywhere from 57% to 90% through the buying cycle before they reach out to the vendor. The big challenge is to build brand awareness in a structured, systematic, and cost-effective way, leveraging both outbound and inbound marketing.

Unfortunately for both the buyer and vendor, many great products are not given mindshare because they are not easily discovered and researched.

Introducing Moxize

Moxize LLC is a company that simplifies the discovery, research, and collaboration needs of Enterprise IT Buyers during the buying cycle. Accessed via www.moxize.com, we serve as an online educational platform that allows IT professionals to learn about enterprise vendors and products in just a few clicks.

How does it work? First, we perform independent research, we work with leading subject-matter-experts, and we partner with vendors. Second, we created a highly structured and organized platform specifically designed for IT professionals fulfilling their Enterprise IT Product discovery and research requirements. Finally, we develop value-add tools, like collaboration, which allows users to save significant time and energy working with other stakeholders during the buying process.

Founded by a team of industry veterans in the Enterprise IT Performance Management space, we have worked with thousands of prospects, customers, and partners - allowing us to conceive the premise behind starting Moxize and our mission.

1. Acceptance of Terms

Moxize, LLC ("Moxize," "we," or "us") offers an online IT Discovery platform and community through its website located at www.Moxize.com (the "Moxize Site"), mobile applications, and desktop applications (collectively, the "Moxize Service"). By registering as a member or by using the Moxize Service in any way, you accept these Terms of Use ("Agreement"), which forms a binding agreement between you and Moxize. If you do not wish to be bound by this Agreement, then do not use the Moxize Service.

Moxize reserves the right, at Moxize’s sole discretion, to change, modify, add or remove portions of these Terms periodically. Such modifications shall be effective immediately upon posting of the modified agreement to the website unless provided otherwise which posting shall constitute notice of such modifications.

Your continued use of the Moxize Service following the posting of changes to these Terms will mean that you accept those changes. Use of the Moxize Service constitutes full acceptance of and agreement to the Terms; if a user does not accept Moxize’s Terms, he or she is not granted rights to use the Moxize Service as defined herein, and should refrain from accessing the Moxize Service. Moxize reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, any or all of the Moxize Service. Moxize shall not be liable to any user or other third party for any such modification, suspension or discontinuance except as expressly provided herein.

3. Moxize Account

In order to access some features of the Service, you will have to create a Moxize user account. You may never use someone else’s account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify Moxize immediately of any breach of security or unauthorized use of your account.

Moxize will not be liable for your losses caused by any unauthorized use of your account. However, you may be liable for the losses to Moxize or others due to such unauthorized use.

4. No Unlawful Use

You agree not to use the Moxize Service for any purpose that is unlawful or prohibited by these terms, or the terms of a subscriber agreement you have with Moxize, if applicable. You may not use the Moxize Service in any manner that could damage, disable, overburden, or impair any Moxize server, or the network(s) connected to any Moxize server, or interfere with any other party's use of the Moxize Service. You may not attempt to gain unauthorized access to any portion of the Moxize Service, other accounts, computer systems, or networks connected to any Moxize server, through hacking, password or data mining, or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available to you on the Moxize Service.

5. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, MOXIZE DISCLAIMS ANY RESPONSIBILITY FOR THE DELETION, FAILURE TO STORE, MISDELIVERY, OR UNTIMELY DELIVERY OF ANY SUBMISSIONS OR UPDATES.

THE MOXIZE SERVICES, AND ALL SUBMISSIONS AND OTHER MATERIALS, INFORMATION, PRODUCTS AND SERVICES INCLUDED IN OR MADE AVAILABLE IN CONNECTION WITH THE MOXIZE SERVICES ARE PROVIDED "AS IS," WITH NO WARRANTIES WHATSOEVER. You will indemnify, defend, and hold harmless Moxize and its affiliates, directors, officers, employees, and agents, from and against all third party actions that: (i) arise from your activities on the Moxize Service; (ii) assert a violation by you of any term of this Agreement; or (iii) assert that any content you submitted to Moxize violates any law or infringes any third party right, including any intellectual property or privacy right.

7. No Promises

YOUR USE OF THE WEBSITE OR ITEMS OBTAINED THROUGH THE WEBSITE IS AT YOUR OWN RISK. UNDER NO CIRCUMSTANCES SHALL MOXIZE OR ITS LICENSORS BE HELD LIABLE FOR ANY DELAY OR FAILURE IN PERFORMANCE RESULTING DIRECTLY OR INDIRECTLY FROM ACTS OF NATURE, FORCES, OR CAUSES BEYOND ITS REASONABLE CONTROL, INCLUDING WITHOUT LIMITATION, INTERNET FAILURES, COMPUTER EQUIPMENT FAILURES, TELECOMMUNICATION EQUIPMENT FAILURES, OTHER EQUIPMENT, TECHNOLOGY OR, ELECTRICAL POWER FAILURES, NONPERFORMANCE OF THIRD PARTIES OR GOVERNMENTAL ACTIONS.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF MOXIZE, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER THEORY, ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SITE, THE SERVICES OR THE CONTENT EXCEED THE COMPENSATION YOU PAY, IF ANY, TO MOXIZE FOR ACCESS TO OR USE OF THE SITE OR THE SERVICES IN THE TWELVE MONTHS PRECEDING THE CIRCUMSTANCES THAT GAVE RISE TO THE CLAIM.

In any jurisdiction that does not permit limitations of liability, the foregoing limitation may not apply to you.

The Moxize Service displays and/or makes available content, materials, and links to a variety of formats (such materials, and files that are linked from the Site, are collectively referred to as the "Submissions"), which are uploaded or linked to by Submitters, over whom Moxize exercises no control. Moxize cannot and does not screen the Submissions before or after allowing them to be made available to third parties. Submissions may contain material or links to files that some people find objectionable, inappropriate, or offensive. We cannot guarantee that any Submissions made available via the Service will be free of objectionable content. We therefore assume no responsibility for any Submissions on, or otherwise linked to, the Service.

Moxize provides this Privacy Policy Statement to make you aware of our privacy practices and the choices you can make about how your personal information is collected and used, both on-line and off-line. Our users are very important to us and we take your privacy seriously. We understand that building a long-term business relationship with you depends a great deal on trust. This trust begins with our commitment to respecting as well as protecting your privacy.

Moxize provides our users the ability to register an account using their business email address, their LinkedIn account, or both. In order to create a Moxize user account (“Subscriber”) via LinkedIn, you are granting us access to your full profile and email address.

Portions of information that we receive from LinkedIn with other information that we collect from you with your approval may be stored. LinkedIn controls the information that it collects from you. For information about how LinkedIn may use and disclose your information, including any information you make public, please view LinkedIn’s privacy policy. Moxize has no control over how third party sites use and/or disclose personal information it collects about you.

4. Information Collected (automatically)

We may automatically collect the following information about your use of our Site or Services through cookies, web beacons, and other technologies. This data includes your browser type and operating system; web pages you view; links you click; your IP address; the length of time you visit our Site and or use our Services; and the referring webpage that led you to our Site.

Moxize uses the information we gather about you for the following general purposes:

  • To manage your account, including to facilitate your access to and use of our site as well as personalized features of the Site and Service (e.g. Dashboard, Follow Category, Follow Vendor, Follow Product, Add Content, My Notes, etc.).
  • To communicate with you in general, including to provide information about Moxize and invitations from the Moxize community.
  • To communicate with you specifically for notification related to your Followership and settings for Dashboard features.
  • To measure interest in and improve our products, services, and Websites.
  • To notify you about special updates, offers and products or services available from us or our partners that may be of interest to you.
  • To otherwise customize your experience with Moxize and Dashboard.
  • To solicit information from you, including through surveys.
  • To resolve disputes, troubleshoot problems, or provide help as related to Moxize.
  • To prevent potentially prohibited or illegal activities.
  • For marketing and promotional purposes. For example, we may use your information, such as your email address, to send you news and newsletters, special offers, and promotions, or to otherwise contact you about products or information we think may interest you.

A cookie is a piece of information either stored temporarily in your web browser’s memory space (session cookie) or placed on your computer’s hard drive (stored cookie). Session cookies are destroyed when you terminate your browsing session by shutting down your browser. Moxize only stores a randomly chosen unique ID number and a context, both of which are meaningless to others, but help us uniquely identify you. This gives our platform the ability to bring more personalized and tangible content to your attention.

We use third-party analytics technology such as Google Analytics to gain visibility and evaluate the usage of our Site and Service. We use these analytic tools to help us improve our Services, user experience, and performance. We do not share your personal information with these third-parties.

Our Site and Service, as well as the third party material displayed on our Site and through our Service, contain links to, and may allow you to visit, other websites (“Third-Party Sites”). If you choose to visit any of these Third-Party Sites by clicking on the relevant link or navigating to a Third-Party Site, you will be directed to that third-party’s website. 10. Security of my personal information

We have implemented commercially reasonable precautions to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our best efforts, no data security measures can guarantee 100% security. You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

11. Access to my personal information

You can modify your account information and/or cancel your Subscription at any time by visiting your account profile page on the Site. If you cancel your Subscription we will remove your personal details from the subscriber base, but if your personal information has been previously shared with a Vendor, you will need to contact the Vendor directly to request your information be removed from its database. You can cancel your account in accordance with our User Agreement.

If you cancel your account, we may retain your personal information but only for the purposes of preventing fraud or future abuse, enforcing our User Agreement, protecting against harm to the rights and property of Moxize and its users, and if required or permitted by law. All retained information will continue to be subject to the terms of this Policy. You have a right under the Act to access information held about you, subject to an administrative fee to meet our reasonable costs. You may also ask us to stop processing your personal information at any time.

12. Children's Privacy

Minors under the age of eighteen years old are not eligible to use the Site and we therefore ask that minors do not submit any personal information to us or use any of the services provided on, through or by the Site (the "Services").
